I've seen dozens of people exploiting sub-labor and got their gc's. There are thousand's of them jumped the queue for last time in July '07. I do agree with the person who started this thread.

The link you have posted seems to talk about allowing to file for 485 even though the priority date may not be current.
It would be difficult to combine both the proposals. The combination would mean that everyone would enjoy the benefits of being allowed to continue living and working in the country with no annual limit. Which basically means no control of immigrants.
I am not in anyway opposing this. But we need to look at it based on how the decision makers are going to perceive it.
I feel what is being proposed by 'realizeit' is realistic and will not hamper the annual limits. It would be good if someone has contacts with the AILA and can persue the matter as a coalition effort.

This ain't nothing. Wait until the second wave of labor substituted EB3 applicants port their case from EB3 to EB2 or EB1 .Talk about a double whammy. Except a bigger hit in the next year or two when most of the porting succeeds.

My passport was renewed by Consulate of Chicago and the fields last name and first name were interchanged.
I used the miscellaneous service form. The reason i gave was other and also did not fill my name on the form. I took it to the consulate along with my old passport and showed them the error. They agreed to make a correction and then I filled in the name on the miscellaneous service form the the way i wanted it to look like.
They provided an endorsement on the second page of the passport and this should be good for travel and all other purposes. I did not need an affidavit as the old passport was used as the proof.

The truth is...yes, we may be. But we are the ones who will eventually make a difference. If you read the quote from George Bernard Shaw, you will realize that the reasonable men and women will sit around and talk about us, save their time for family and leisure and comply themselves to the system. They will comply themselves to a system that keeps in hanging without a green card for 20 years. They will never be capable of ushering progress.
The unreasonable ones, the ones like us, who contribute to this cause in various forms, are the gifted ones. We are the lucky ones. For we have the wisdom and the strength to do the unreasonable and get the world to comply to our point of view.

Not having participated in any previous efforts, the skepticism I had when I landed in DC vanished the moment you started the training session. You are right, if we are not goaded into action, we are content to refresh the visa bulletin every 1st Friday of the month - why 20? 50 times a day!!
Never once did I realize that by clicking on refresh button - I am actually doing nothing to change the outcome of what will be published. However, during the training, during our lawmaker meeting in DC - I realized I AM ACTUALLY WORKING TO CHANGE THAT VISA BULLETIN
I realized that my participation will not bare immediate fruits but just that I added a good dose of Miracle Grow and Water. The amount of sunshine is controlled by the powers beyond me, but IV and I are working to make sure that our plant does not get overshadowed by larger trees. Will I be ready to add more Miracle grow in the next 4/5 months? ABSOLUTELY.
Every IV member can take this as a challenge or as a request - watch the political environment and follow what is happening on the IV forums and action items. As things get warmer, talk to your bosses, spouses and be prepared to participate in Lobby or Rally efforts that will propel our issues to the forefront and get the solutions (be it in whole or partial). Be prepared to participate. Find reasons to participate in such efforts and not excuses/contention/indifference. If you can't do it, find others to take your spot. Do what it takes.

In the initial update release by INS, it is stated that
"USCIS will reject all cap-subject H-1B petitions for FY 2008 received on or after Wednesday, April 4, 2007."
They are saying that they will reject and they obviously are not meaning that they will REFUSE the Courier/ Post the application materials received after this date. So, it could happen that they will accept all applications that are being sent but will reject only after they confirm that they have reached the limit.
So, what if Master;s quota does not reach the limit? so still might have a chance. So, try to find an employer who will be willing to hire you and sponsor your H1 under Master;s quota. So, if they have received less applications and start looking for the ones received after April 4th you might stand a chance.
One another factor is "You do not have a masters degree yet and you will not have it until May as you are graduating in May. So how will your application be treated as Masters" here is my thinkng
you will file with all the available supporting documents and you will make it appear as if you indeed are filling under Master's quota. Your application will have insufficient doccumentation and they will raise a query on your app. and by the time this happens you can hope that you will receive your degree, or you will delay it till the maximum possible extent and will send them back with supporting Masters Degree. Again these are just my thinking you might want to validate with some professionals as whether or not this logic stands a chance.
Even, if you do not get a chance to apply now. I do not think you need to defer your master. Go aheah and complete your masters as planned and accept the opt. You will apply for H1 in 2008 for H1 to start from October. Now, the question is about the period June - October 2008. You can enril your selves in some short term course, Kaplan has some which will also give you I20. So these courses will help you sail during this period.

While, I have not made any analysis on this or do not have any basis, I just reiterated what unitednations and others have written before.
From my perspective (once again, this is just my thoughts), it looks like a slowdown or apply hard country limite for highly subscribed countries maybe a result of a lot of factors like, job market slowing down (2001,2002), complaints that immigrants are taking local jobs, consulting companies selling labors, falsifying resumes to INS or DOL (java programmer actually working in restaurant), people not getting paid prevailing wage, benching etc..... While a comprehensive reform is a good solution to retrogression and all h1bs are taken as serious immigrants, underlying issues need to be fixed before a comprehensive reform to retrogression is there. A lot of loopholes being closed and strigent rules being enacted, change is some laws that don't make sense, understanding the industry needs, issues with wage and tax issues, are things that can be happening behind the scenes (this is just what I think), in addition to backlog elimination and overflow of applicants in an overburdened system.
Once again, it is just my thoughts, which I think explains the patterns to why unused numbers are not flowing to over subscribed countries. Please correct me if I am wrong.

I like srikondoji's idea. Infact I had pitched it to Pappu in a pm couple of weeks ago. Lets create a list of members who wish to sign up for bi-monthly contribution by say Dec 31st and publish that list. ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item

That validates my reply previously to a posting by a guy who said that he had called up TSC and they said they go by RD...I had asked him to call back after a day and he'd get totally opposite info.
My situation is the same.....I was TSC-CSC-TSC....but I had received an RFE last year.....dunno why will they preadjudicate and then go by ND which is totally non-sense...logic should be that if a case is preadjudicated it should be put on based on PD..
Again USCIS don't follow any logic...
As I said b4 very few transfer cases will ever get approved.....just bid your time...or apply thru EB1 chances are better that way..

Received receipt notice on 30/04/2007 which mentioned RFE mailed on 30/04/2007, however till date the lawyers have received nothing, does it take that long for the RFE to reach the lawyers??? its already been 13 days...Please respond...

I read that he is here since 2007 and card production has been ordered, we are here since 2000 on H1B with no end in sight. Really painful
If anyone gets year 1800's labour legally through their employer I would not find it problamatic. If someone gets it illegally by paying money or something I would call it wrong.

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.
One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?

Off topic, but I'm confused in figuring out the standards for closing topics in this forum. I've seen threads with much lower tone, fewer personal attacks and cleaner language being called useless bickering and closed.
I don't mean anyone personally, and I can be wrong, but to me it seems like if the people involved are not moderators and expressing reasonable argument against an IV goal or IV practice it's quickly a target for closing. While if a moderator is involved and has enough supporters to overpower the other party, the thread is kept open with no problem even though it's the same level of bickering and insult exchange.

personally i hate closing threads. i give tons of warnings and keep stating...i will close...but rarely do :-)

we seem to succeed intermittently....until we are thrown back OT :-)
