As a highly-skilled Employment-based immigrant living in Michigan, I am appalled to know a respected bank like Franklin Bank- with a diverse workforce - is sponsoring an anti-immigrant show like "WWJ Business Breakfast" with Mr. LOU DOBBS, which is scheduled to air on Nov 29 between 8 a.m. - 9:30 a.m.
Mr. Dobbs is known for his strong views against immigrants, including considering immigrants to be responsible for the spread of incurable diseases such as Drug-resistant Tuberculosis, Leprosy etc. From past experience on CNN, he is also highly likely to blame the current crisis in Auto Industry to the so-called "importation of cheap labor from third world countries".
He is known to make exaggerated statements such as "Four hundred thousand H1Bs granted in a year" where as facts show otherwise. As per government figures, federal government awarded 124,096 H-1B visas in the fiscal year ending October 2005, the most recent annual totals available. That includes renewed visas, which don't count against the annual cap. These dramatic exaggerations distort the reality and provide a falsified alarmist view of the situation; which works against the interests of Immigrants ,businesses and American economy.
It's not in the best interests of a respected bank like Franklin Bank to associate itself with a blatantly anti-immigrant show, that can harm the bank's image in the community. I request you to withdraw sponsorship of the show in the best interests of your bank and that of the immigrants in the community some of whom may be your workers, customers and business associates.

I know this is a pretty old thread, but interested to find out if you give some tips on starting this business on a H1B and how i can withdraw profits from that?

What exactly do you mean when you say starting this business? Do you want to open a trading account on your own and trade? Join a day trading firm? Or open a Fund? Each one will have different implications on H1. You can open your own investment account with a brokerage firm and trade your own money, no problem with H1 what so ever.
If you join a day trading firm you will have to be on H1 with them. Very few ones do but I know of a couple who will do it. In fact a classmate of mine is working as a Trader/Analyst with a small trading firm in NYC. They have sponsored his H1.

The intent of US immigration (employment or otherwise) is to import diverse population such that it benefits US in various different ways (socially, culturally, economically). Employment category comes under the larger umbrella of such goals.

Diversity is definitely not meant for EB based categories. EB immigration is purely based on merits. I think you are inventing a new "intent" here.
I remember one republican member of judiciary committee recommending to get rid of Diversity visa category all together and granting those visas to EB category while discussing the visa recapture bill.
He also proposed to reduce FB immigration and grant those visas to EB.
Why are you sounding like an anti-immigrant ? Did you already get your green card ?
Anyways bills and amendments are meant to fix laws that are outdated or irrelevant.
If US was really concerned about diversity, they should take into account the ethnicity of all GC holders and citizens when considering the country limits.

Ron, while you may have a point in what you say, sarcasm and taunts will get you no where. As you said, the 'antis' are gearing up, suggesting (I presume) that the effort of all of us should be more concerted and determined. But you are not doing yourself any favor by saying the things that you do.
Raji had a point of view, and has not been rude or offensive in expressing it. In fact, her/his first post was out why it is not good to use the AILA template. Well, PASKAL did try to address. Raji's tone or tenor of posts did not merit a peremptory reply, much less a rude one.
Be that as it may, I do believe fervently that even if someone insists/demands an answer, you can always ignore it instead of being rude or aggressive.

He hates Illegals and not legal immigrants. I almost have heard him everyday going back home from work and all the time I have heard him saying there are people who legallly coming here for work that he supports. He always has been against "Amnesty" to Illegal Immigrants.

This is good news..But the Damage is already been done..in the past.....
I guess DOL had some 300K cases pending when Backlog center started..It adjudicated some 150K till now.( Rough Estimate) and still 150 K left.
Even if considering 10000 Labors been substituted till now ...Imagine the wait period for rest of us. I wish this law was enacted, when they started Backlog centers..
Anyway..something is better than nothing....Hope for the Best...for new laws regarding SKIL,CIR Etc..atleast filing 485 when Visa numbers are not available..

It will still leave a door open for sellers to stay happy and able to substitute labor. However it is not easy to find a buyer of a LC in 45 days.
All these are small problems compared to retrogression. Labor substitution rule will not get any visible or any noticeable relief to us. We will continue to stay retrogressed and wait for another 10-15 years for our greencards. It is important for us to contnue to fight to end retrogression by getting a legislative change done. As long as members are there to support IV, the organization will use every means to get relief measures for all of us. The coming months are crucial to our struggle. We need to stay united and continue the effort of making this organization a formidable force on the hill. IV members writing negative comments on various forums or feel disheartened should know that to get even a smallest job done is not easy. They are not only harming the whole effort and making anti immigrants happy, but also harming themselves by hurting this cause. Sometimes it is sad to read such negatve comments when you know how hard it is to work with limited time, resources, manpower and lack of much needed motivation in members.
BTW In our recent efforts we did give anti-immigrants shivers down their spine. It can be seen from their posts on their sites and also the hate mails they write on our forum and send to core members. You dont see a lot of it because we moderate posts. We are not scared of anyone. All this has only made our resolve stronger to fight it out and fix the system.

The conventional wisdom, overall, in DC is that when it comes to Legal EB immigration, Republicans are our friends.
If you are an illegal Democrats are your friends.
These days, the dems and republicans have joined hands against illegal variety. There hasnt been a litmus test of legal immigration on Dems or Republicans. I dont think S 1932 was any indication on where congress stands on our issue. S 1932 was a budget reconcilation bill and they had bigger fish to fry: Budget reconcilation. In order to garner support from their own party, republican leadership had to drop immigration and other non budget related things from 1932. Tancredo and Smith can only have fun as long as there is tough opposition to any bill. On bills of like PACE having 60 senators and hopefully majority on board, Tancredo, Byrd, Smith and cheerleaders like him may not have bargaining power they had during 1932

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

I think, we should start another flower campaign for Condi....she too deserves to be bombarded with flowers....I was appalled listening to her views/opinions TV on the July visa bulletin fiasco....

u can keep renewing your H-1 as long as your 485 has been pending for more then 180 days.(someone corect me if i am wrong).Once u get ure recipt number ure status changes to "485 pending" and can be on h-1 as long as ure GC is approved.No matter when u get married your wife will not be out of status-so its a good decision that u applied.
Hi Priti, thanks for the reply. However my fear is that what you say is not true. I am on my 7th yr extension of H1B and my lawyer has told me that once I apply for 485, I can NOT keep renewing my H1B. That is why he insisted on applying for AP.

If credentials were in Q, it would be pointless raising any Qs at all. Qs are only asked of whom you trust to give a reliable answer. While the Core and indeed the Donors are dedicated and smart, many members here are as interested in following the progress being made by IV and yes smart enough to understand that every organisation has strategies which it may not wish to reveal � the Qs here are not about strategy, they are about updated information and increased awareness amongst those IV calls its base. If a free and open discussion about this is only to be cut short by a member being told pay or not be curious, then this is not really a public forum and this needs to be clarified at the very start.
Of course IV can continue to get rid of people it does not like raising Qs by putting them down, but this is not the greatest public relations exercise - especially with the population the group seeks to serve. This world is not a one size fits all and - there will always be people who pop into a forum for the occasional Query - if we answered them nicely, updated them on progress, they may themselves consider this a worthy cause, donate, update their profile and contribute as best as they can. Alternatively they may never become donors, but will at least ensourage others to visit IV, become members, and support the cause. But if we ask them to fulfil multiple conditions before showing empathy, we lose them forever. I partially agree with you. Btw, not all students have to prove that they would not work in US. Actually, my interview was fairly simple and pretty hilarious(that's a different story).

Believe it or not, I know a consultant who lives in one of those "guest houses" where consultants who come from India are housed, and there is a guy who lives there whose job is to cook, clean and buy groceries for the housmates. HE HAS A GC APPLICATION PENDING! And people like me and many others who truely deserve to be hired and retained in this country are facing an uphill task of getting through the GC process.
That cook guy came to the US with a Bachelor degree in commerce, called B.Com. He hasn't been able to get a project for 4 3 years now. He doesn't get paid by the company. He is just a freeloader living there.
Imagine how many suck "cooks", "maids", and gas station employees might be out there clogging up the system!

Well said. They have their own self interests in their mind...
Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)

True, but you are forgetting the basic definition of demand. Demand is willingness to buy supported by ability to buy. If you are from any metros in India, think how many of your Non-IT, mainstream friends draw more than Rs. 50,000 per month? How can someone making even Rs. 50,000 a month afford 50 Lakh flat?
If there are 10 people drooling out side Ferrari showroom that does not mean there is demand for 10 Ferrari :)

I understand. Even for NRI it is difficut to afford now. The issue is the numbers. How many H1b and L1s come to US from 1990 t0 2008. Very very conservative estimation wil be atleast 2 million. This estimation ignores other NRIs in other country. Apart from this there are many resident IT folks makes 6 digit salary plays the role. If most of them tries to buy, we need to find another India. Indian real estates become a NRI colony,
