Did you use PO box as address on I-485? I had heard USCIS does not accept PO box as address in I-485.
they do according to my lawyer and I got my welcome notice the last time sent to my PO BOX the first time they sent the Welcome notice they sent it to my physical address not PO BOX but because the address didn't have the C/O name of my friend and then my name so the mailman when He read the name and looked in the mailbox he didn't found my name so he returned it to the sender USCIS if USCIS wrote C/O...he would of let it (the mailman) the second time USCIS sent it to my PO BOX directly ( what they did they included the original envelope that was sen to my physical address with the return to sender tag and the time received and sent ... + the original Welcome notice with the physical address on it all these two item sent in another envelope sent to my PO BOX

The VB mentions that dates will revert back to the June bulletin and the current says that they may retrogress. We are being too optimistic. before people start the bashing, i am EB3 retrogressed and have sent emails and letters about this issue, still waiting for a response. A query to my congressman came back with more spin about national security and how they are comitted to meaningful immigration policy, nothing from the letters to Rep. logfren and USCIS. Oct VB will be an eye opener for us as well as other EB2's and EB 3 ROWs.

I would strongly suggest everyone to acquaint himself/herself with the legislative process and how a bill moves through different phases / steps before it becomes a law. You can find many postings documenting the process.
Right now it is just introduced in the senate. The problem for us is that Sen Durbin is Democratic Whip (i.e. Assistant Majority Leader) which gives him tremendous influence over garnering votes and referring which legislation to consider to the Majority Leader (Harry Reid in the Senate). Ultimately Reid decides which legislation get priority consideration. The fact that Grassley is a Republican and is close to the Minority Leader (I think) does not help us either. We will monitor the progress of the bill.

As per my attorney (one of the top 3 in the country), there is already more than enough proof of rejection, which means an actual rejection package is NOT needed at all to proceed with Class action law suite
Example is revised visa bulletin, and that IS sufficient.
Infact, i tried to get some info, but all i got was "something favourable might happen ". That's a very generic statement and means nothing according to me.
It very well could be deliberate, no rejection notices mean, the lawsuit will be weak.

For all of you who have send me a pvt. message asking me how to reach IO @ TSC, here are the steps:
1) Call Customer Service @ 1 800 375 5283
2) Continue in english, hit 1
3) To check the status, hit 2
4) Know your receipt number, hit 1
5) Enter Receipt number, and then for SRC, hit 1
6) Confirm Receipt Number, hit 1
7) You will now hear the status of your case. At this point, hit 3 to "Report a problem".
Here is the trick - now you will hear 4 options. I believe # 3 is "If your case is outside the processing time..." and # 4 is for "If you have filed several cases and have received a decision on....". You want to hit # 4 and you will be connected to an IO at TSC.
Just a word of caution: You will be talking to an Immigration Officer @ TSC so please be very polite. Some officers will tell you that they cannot give you any information, or you should be calling Customer Service number, simply say 'Thank You' and hang up. It might take days/weeks before you reach an IO who would be willing to help.
Again, the sequence is:

For my situation discussed above, I took an infopass appointmnet at Baltimore and they couldn't offer a concrete answer since the case is pending with TSC. They asked me to reply to RFE asking for extension and provide supporting documents. I'm not sure if that would be accepted and results in denial of I-485.
In 2005 for a family based I130 I recd an RFE for birth cert which was not available and somehow could not arrange for the negative certificate in time and asked them for an extension as my papers were to come from from mumbai and it would take more tiime as we had to get the documents from courts in mumbai and ahemdabad.I was sent a denial notice and had to fie a motion to reopen and pay attorney extra money to get the case reopened.So as far as I know they do not issue any time extensions and would decide the case on basis of documents submitted and if these documents are letters asking for more time then I assume they would deny the case as they did for me in 2005.

Hey guys, thanks for the replies and the good advice, which helps a lot. It's true that prevailing wage for H1b and CG are different, so I don't think my employer is breaking the law...at least not yet. (Logiclife, what do you think? Wouldn't the attorney had told them that they are breaking the law?) It's just a hard reality check to realize that all the "we care about our employees" is just a smoke screen.
They do care about employees. They just can't handle immigration and visa issues. It is too complicated for a lot of employees. For a lot of employers, the term H1b visa or sponsership gives "jitters".
While a lot of employers look at things from their perspective, they do understand all issues that you face. It all depends on how important you are and if your absence would make a difference. If you are irreplacable, and employer thinks they must keep you at any cost, then they will do it, or you have to take care of yourself.

US citizenship is a final stop for most/many immigrants. Post Sep 11, there has been a surge in nationalization applications because technically GC is like a long term visa to stay permanently. Therefore there is always a risk of losing GC because of DUI or other trivial or accidental issues etc.
Also post Sep 11, a lot of govt/sensitive projects that were available for GC only have been restricted to US Citizens. You lose a significant chunk of the available jobs market if you are a GC holder in the Maryland/DC/North Virgina area. In fact I know a lot of GC who kept their old passports but because of these hassles eventually decided for Naturalization.

This week i became an USC after 9 years of stay in US. I can retain USC and stay in India. Came to US in 2000. Applied GC in 2002 Jan got the green card 2003 December with EB3

I will reach out to ombudsman and Napolitano this weekend. Another thing i am going to try is applying AP renewal this weekend, set to expire in november anyway. I would rather loose $305 than keep waiting for some miracle. Thanks for your help. I should be able to find the procedure to file 7001 and the Napolitano address in this thread, correct?

I dont remember seeing this response but to me it sounds promising.
Please continue to follow up, and in the meantime, send a letter to everyone you can (senator/USCIS sec./first lady/go for Infopass).
Edit: Forgot to mention, please print out the email response from CIS Ombudsman and put it as a supporting document when you send your case details to USCIS Sec. and others. Any response you get from USCIS, you should put it as a supporting document when you send your case details to higher authorities.
