When can you file WOM? It's a grey area. When the Name Check has been pending for more than 2 years like in my situation, then you definitely have "a case". However, I have heard that some people do it after "only" one year.
Impossible to tell really when it's the "best" time to do it...

Not sounding too pessimistic - but I do not see any option in the 7th year, than making my employer richer by the day.
Have let go two excellent opportunities slip by in the last 6 months from highly reputed Consulting companies while continuing to work for my desi body shopper.
Already have a US MS - and given the question on ROI, decided against an MBA.
Hang in there.. and hope for SKIL to pass.

I'm like everyone else - 7th year on H1-B. Sick of thinking about my career. I filed my labor in Aug 2002 EB-3 and so I'm also a retro victim. I'm convinced that GC will take another 5 years to come to my date.
There are few options:
1. Apply for Canandian PR and then if you are lucky you may get a good job in Canada in IT or else you will end up working in Wal*Mart or some grocery store cursing why you came here. Canadian Companies wants Canadian experience. US experience is not enough! :(
2. Just enjoy without doing anything and hope that your GC would come before you die. :D
3. Do some Masters degree. I'm currently erolled in a masters program and would somehow try to finish it. It would keep me focussed and create positive energies in me. Otherwise due to utter frustration, I'm not able to concentrate and work. If you are wise enough you would understand that there is no place for you here in US and you would push off immediately. :)

If you bring in a worker with a path to citizenship and make the laws so ambiguous that even after 10 years he/she does not know when to reach the destination in that path is a violation of basic human rights.
2) US has every right to choose whom they want to have in their country.
The choice kind of goes back and forth. Getting H1b - yes You can work...Delaying/Rejecting GC...No can't work. It may be rejected without even the fault of the individual. Path to citizenship is an eyewash...there is not path to citizenship for a foreign worker at individual level.
4) Considering the number of fraud's committed by Indian ....
Punish the guilty and do not stereotype. USCIS report says only 20% of H1b is bad.
5) We all have best back up....Saare Jahan Se Achha....
This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:

3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option. That is not true. In fact I would say that many people who leave have lot of guts. they may have other priorities like family, social etc. I know many naturalized US citizens who have sold their homes and are / about to go back. some IITians left because of green card issues (one of my friend tried to apply ..company was laying off H1B's ..he moved to NY financial company and now is in India at higher post. in the end it is priorities that you have in life.

Don't fight for Eb2 vs Eb3 or Eb2 vs Eb1 etc. If we focus on these 3 bills then it will solve all our problems.
(1) STEM bill remove all MS + Phd people so Eb2 will be half empty and Eb1 will be 80 % empty.
(2) Re capture will bring new visas where they will go certaily to Eb3. ( Eb1 and Eb2 do not need visa if passes STEM bill )
(3) No Country cap limit. Will clean Huge line of Eb3 india, China , Phili..

I think SKIL bill is our only hope. Unlike CIR, it looks like this bill has been introduced in both the houses which is a good sign. This bill has more number of sponsers from the House than in the Senate. That's another good sign.

That seems to be the way where this is heading. Would this be another july fiasco?.
I dont mean to sound negative but I desperately need a way to file I-485 for my wife to get EAD. She has been rejected twice just coz she did not have a work permit/or was not a GC holder/citizen.
Mind you she has a brilliant engineering academic record and worked in India for 2 years a Java programmer before marrying me :mad:
I don't know if USCIS has "wasted" visa numbers but just like the Government has been "borrowing" money from future why cant they borrow "visa numbers" from future (or even past for that matter)...does sound ridiculous :eek: The economy is in recession for last 2 years for sure. Less and less number of folks are filing for GC. I would expect the EB1 numbers spilling over big time to EB2. That has not happened. Its been 3 loooong years after the July 07 fiasco and USCIS still doesnt have enough numbers to clear the backlog...this is BS.
Bottomline is we do need USCIS to advance the dates rapidly enough so that thousands like me can be relieved of their daily ordeal in US....sorry for the selfish thought..:o I just had a shot of tequila....
