Each existing member should get at least one new member to join up. The more, the better.
Secondly, we need more members to become paying members. This is crucial, as all our work requires $$$. Saying "I'll pay when the work is done" does not help us. The work requires a steady cash flow, and while pledges are deeply appreciated, we can't operate merely on pledges. Many core members work very hard on raising money and on publicity.

I dont think companies are really geared to file for 140 within 45 days of labor approval...
The condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee.
There is no time limit set to file I-140 for the employee for whom the LC was issued.
AILA opposes this 45 days condition on the premise that they can not find and recruit a person to apply LC substitution within 45 days.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. If you look at the ICE's public releases you will see they start investigating a case months before they announce their conclusions. I know in some cases the employers will be able to get away with small fines but we should not let this stop us.
I agree. There haas to be a start. Like how Obama has promised he will make corporate CEOs accountable for the mess they create and move on, we must also jump start the community towards cleansing the system.
The CEO level corruption, if held accountable, we will see less of layoffs etc.. and we can see the good old days permanant jobs that are "really" permanant

You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.
Lets target the 'Asses' asking for a kick. Let's all kick ass.

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

Guys, please make mention about the wastage of estimated over half a million visas over the last decade due to bureaucratic and processing inefficiencies at the USCIS, while we have been waiting patiently.
The best outcome for us in all honesty would be a visa recapture legislation to get those of us at the 485 stage out of the system.

No questions related to job..more about my spouse AOS..officer told me visa is granted and it is almost 1 week and no change in passport status on vfs site. I am bit worried..i will call consulate tonight..

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!
