May be that is the reason you took offense when people commented on Bcom thing. An MBA is valuable only if your bachelors degree is valuable. Many people have this wrong notion that it does not matter what you have in your bachelors, if you get an MBA everything is all set. Companies need engineer + MBA combination. Very few companies hire MBAs for accounting work. DOn't confuse accounting with finance, they are different. I can tell you that for sure, as i work in finance.

I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.
There could be some background processing going on.
Is there are pattern to these LUDs?
What steps did you take after the NOID on your 485? Just curious in case it happens to me.

Mr Logiclife - you have put things in an excellent manner. It is very true that we are no less than citizens. Citizens, non citizens, aliens etc.. are terms used widely that actually confuse people. For example the term "illegal immigrant" sounds more immigrant than a "legal alien". People just dont understand what is what. I have noticed a lot of people having their own wrong opinions about h1b visa holders. People do not understand what is what. In fact most people on h1b visa do not even know or understand retrogression or other issues. For eg.. I was talking to my friend in India and told him about the issues here, he did not understand, he thought I am having a tough time here and told me he has some friends in US who can help me out with immigration problems. When I explained our issues to some people here, some understood and some did not, they told me they know some lawyers who are very good and can help. One of my old employer started a new company in Atlanta and contacted me and asked me to join, but I told him I cannot because I am stuck with my ppresent employer and will lose priority date blah... he did not understand that and was confused.

Yes, I guess the slowdown will happen when it hits the 2005 mark when PERM was introducted and a lot of EB3 were converted into EB2
I believe overall, in 2005 few LCs got certified compared to the previous years..so i am guessing the real slowdown will start from Dec 2005...

I would say it is a matter of pure judgement. It helps to stay neutral and make your best bet. For example, if you found a great job and the employer is willing to sponsor your H1B - why not go for it? H1B will be safe(r) anyday - it gives you and opportunity to plan for the unexpected. However, it would be imprudent to ignore a great opportunity by sticking to H1b. So, the thing is - don't lean on either side, just do the best that keeps you happy and safe.
One question though - If I apply for EAD & AP - do I have to keep renewing it inspite of using my H1b status? That would be a great loss money, right?

Actually I know a guy who lost his job and joined a restaurant as a cook or something and applied GC, then after 1 yr or so got job again and used the EAD to change to the Tech Field again and at a different location.....I hear he is indeed facing some problems now.

Don't worry - IV core will appear out of the blue when:
1)- there is a good news - to claim the responsibility (regardless whos efforts)
2)- when they are in urgent need of funds (don't ask just give)
Local chapter is a joke for most of the states, in my state there were only 2 meetings in 6 months and in second no one came including organizer :D
So basically by not joining local chapter you are not missing anything! trust me :)
Read/Write => Enjoy IV, Don't compain

btw if people did not come to chapter meetings who is responsible? the leadership is voluntary and does what it can along with their regular jobs and life committments. those like you that perpetually whine and won't lift a finger need to ask some hard questions of yourself though. either this is a grassroots effort or it will certainly fail. fortunately there are members more committed than you who are actually doing things to help themselves even as i speak. there are meetings on with lawmakers and the admin changes campaign is moving. one state chapter has held a lobby day in DC this month and others are all set to hold their own efforts. if your chapter is defunct, help to give it life. or you could slink back into your hole of course...after complaining about others...

I beg the max because I don't think we can do anything without the lobbying firm and other lobbying activities by core, and the contributions are < 20% of the money required. Please convince me that I should stop begging because !@#$%& or explain how to beg when we have < 3% contributing members in 45 days. Very sorry to hear your case. Based on what you said, no one in other cars were disabled or had life threatening injuries. So it is unlikely that the Judge would grant that much money from the Insurance company or you.
You can always file for bankruptcy if worst situation comes. There is no shame in it in such circumstances.

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. I had gone through their presentation sometime back and they were basically complaining about how EB india gets most of the spillover and they don't (along with some common arguments about visa recapture, FIFO etc etc.) You should be able to get details from their class action doc against USCIS uploaded on the site.
when news of this class action lawsuit initially came out, lots of folks on IV were mad at why we were not joining in and that we should launch a barrage of lawsuits against USCIS as well. IV core at that time calmly explained that lawsuit options have been explored and will not be viable but few people listened.
Anyway a recent update on this forum shared that they lost the lawsuit. So on hindsight we saved ourself lot of time, effort and money.

I am surprised how come PD is not current and USCIS denies I-131 based on the grounds that I-485 approved.
Something is definitely wrong here, unless its USCIS system glitch which considers the preadjudicated (pre-approved) cases as approved and then deby subsequent benefits associated with AoS (I-485) pending application.

My I-140 got approved even though my company also did not file 2006 Tax return. My company is a small(less than 30 employee) loss making company. Our company secretary just gave a letter that company has not filed tax return for 2006 and has asked for extension, attached request for extension. If you are meeting any one of the three criteria of the yates memo, there are very high chances of I-140 getting appoved. Search for yates memo and you will get more details. Is your current wages more than prevailing wages? If yes, then you will be fine. Your lawyer has do a very good analysis of companies ability to pay prevailing wages. So work with your lawyer and you will be fine.

In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.
Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..
I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....
me...really sad....

MBA is not about just learning or knowledge. (atleast that's what I saw in the business school). If you really want to know about finance, strategy or economic courses, it is already available in Sloan open courseware website. MBA is about networking and meeting the right people (even if you dont know anything) who can provide leads and opportunities in future. It also helps if it is from a top university with great alumni. I did go to a top 15 school flextime. Did it really help me ? Personally No. But it did provided me with a foot in the door for many opportunities. If you are H1B not looking to get a GC then I would risk it and go for full time. If you have a greencard, then I would risk it again and go for full time. But if you are in the middle of the process and want MBA to help your future growth and if you are planning to do part time, it is a long shot. Most of the part time programs don't really care about their students with respect to career opportunities and they all cater towards full timers. (Those are the statistics that is widely published in the news) It is a cash cow for the university. So the only odd man out is entreprenuership. If you are lucky you will be make it with the first company. But serial entreprenuers will eventually succeed in the long term. My advise is to go for a full time program with a top 15 school, I wish I should have done in top 5. Again there are lucky ones who can make it big even with a lower school, but the odds are slim.
