Considering that there are more than 2000 members who havent contributed yet. Even $10 per member wud mean $20K straight away. Common guys, this is tax refund season. Surely we can all send in atleast between $10 and $20. That is cheap change considering most of our life styles. Internet access costs more than that, Filling your car with a tank of regular gas costs more than that. ;)

I second that. Who knows to accomodate these cases judge might ask congressional approval for recapturing the lost visa numbers.
I think it's better to file now, if your PD is recent.
Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.

not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). This atleast would give us an idea of how many IVers are waiting in eb3 queue..pls discard if you did not like this idea. thanks.

My lawyer says mine was received on july 1st. I am yet to receive a reply from my lawyer. What will happen to the applications received by USCIS on sunday?

I would keep it simple. H1 is a very solid backup in current market. I just don't want to close any options.

I guess it has less to do with estimates, and more about looking at the landscape. If there are significant portion of responses are above your date, one might, for example, choose to initiate porting/reclassification process if one qualifies for it.

Probably his employer is finding excuses not to file his GC and like his employees on H1B.
Dude, whatever it is, get out of that hole if you cant get GC filed.
1. Line up another job.
2. Go there or else, tell your employer, that "Find a way to file my GC, otherwise HASTALA VISTA baybee...".
3. Choose your option.
I was in similar situation. My previous company was merged into a new company, and I got screwed big time on wage issues.
Yeah, I learnt everything the hard way.
But for people out there, if you have a choice, utilize it. Don't give into exploitation

I read through the section 2 of the bill and understand that it targets the areas of FB and EB immigrations. The recapture of visas under the categories are for the individual categories and not just for the FB category.
I would like to hear from some senior members as well as see the IV analysis and position as was done for the bill from Senators Dick Durbin.

Anyways, have you every picked up the phone and called us to ask us what we are doing at that moment? What we did last week, what's our plan next week? You know, there is a phone number listed at several places on the website. That phone never rings. Oh yes, never. So who come you never seek answers where you can get them?
We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.
Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.
So there, you have your update? If you want to know more, then call us on the phone.
And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

It is better to talk to person handling Immigration Issues. If you cannot get hold of him/her leave a VM. if the mailbox is full leave a message with the person answering the phone
