All I did was posting it in August EB2 India/China approvals thread about what I read and heard from an IO. Just to inform people. This visas are not available only for India/China and not for other countries????
If people think it is not appropriate, the admins can delete all the related posts and threads.
Our problem is that we do not want to accept this news. Unless we receive some confirmed news to contrary we should not blame someone who might have shared this news with us in good faith. Let's try to find out the truth first.

hmm.... Well they are really lagging behind I believe.
Is there anyone here who took a letter of completion from the school to apply for the Masters Cap and has got H1B. or cica versa.

The idea is to have the cases of all genuine, hard working, EB2 / EB3 employees who have honestly lived here and are continuing to process the path ot GC legally, be considered from the human angle, more so from the point of view of the education of the children.
When it comes to illegals, people scream about human values, humanitarian considerations, education of their children, family ties etc etc. What about us, who have followed the rules "to the T" ????

Is it so difficult to make you adults understand that the thurst we need year would be the biggest...do you want the tech lobbyist to increase only H1B's (remember they have lot of money). Guys we will lost in the crowd if don't prepare ourselves for the forthcoming face offs next year. We are closing in on the traget, but only thing which can make it happen is more members and more money.

As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached I-140 on these labors that are getting approved rapidly. And the subsequent I-485 petitions on these applications are depleting the visa numbers.

Since your file is at TSC, there is an email address that AILA members have to request that your file be processed once PD is current. Contact your lawyer and ask him to check AILA InfoNet Doc. No. 08103067, that's where the procedure is outlined.
Yes, very good. Sometime late last year, Texas center issued a procedure to let registerred attorneys (not clients) send them a reminder email if and when their clients PD's become current. That should be done so that TSC can pullout the case and get it cleared.

I am not trying to question the dedication of the folks here, but I have not see any plans or goals set for this year.Is this because of election year?
The site has become one more forum site to discuss personal issues and to vent out our immigration frustrations.We seem to be losing momentum on the larger effort of Visa Recapture or even looking forward for any new bills? Well even if we consider that there would be a change in white house, doesnt the senate and house still be intact with the members.
Does IV work with CompeteAmerica or any Lobbying group which could help us with direction?
Just my thoughts for the day.

3. An affidavit, issued in India saying name is being changed, signed by the person whose name is being changed.
OR
1. If you are married and have the original marriage certificate AND the certificate was issued from India AND the certificate has the corrected name, then all of the above are not necessary.
I will try to post the format for the ads and the affidavit shortly. Watch this thread.

Best thing to do is stay here till your visa extension is due,and apply for extension from here,you will get new 194 with your extension if its approved.

The letter actually does not mention all degree requirements have been fulfilled. This left me really upset (I asked the dept to fax it directly to company, so I had not seen it).
It says "XYZ completed all coursework requirements for his PhD in EE at the University ABC, and deposited his thesis on April 11 2007. His degree should then be officially conferred in May 13 2007"
Obviously course + thesis = all degree requirements for PhD, but I wonder if USCIS might question it. The company's attorney (a highly reputable company) okayed the letter and he said denial is unlikely and that they will either approve it or issue an RFE; but based on my readings of other posts I think there is a fair chance that it might be denied.
The irony is that I got a letter from the registrar on April 16, but by that time the attorney had already filed with the weaker letter. I asked him to send the other one when quota was still available but he said it was unnecessary.
Please anyone with similar experience comment.

Please do not try to thwart the campaign. We are trying to address a specific issue, which is about blocking approvals when dates are current, and for that, we are using this current fiasco as an example. The USCIS memo specifically talks about EB2 india, china applicants on hold. Since EB3 was listed as U, we cannot do anything about it. If both EB2 and EB3 were current, I would have given a call to both. There is no belittling out here. the Circumstances are like that.
EB2 and EB3 are working together in the visa re-cpature.
This is a separate issue, but will be useful when visa re-capture is successful.

Lets not strictly follow what USCIS did and did not do in memo. We are all seeing the entire drama for the last 3-4 years.
Every EB3 after a little more experience gets qualified into EB2. Cant the department understand this , which we all do. There is no order. Lets together fight for a common cause and not discrimiate between Eb2 or EB3.
Commonsense rule is , if you are allowing 10 H1s to be processed, then why are you processing only 2-3 Greencards. What abot the remaining 7 and why should they wait, even after 8 years???.
Spillover and quotas are all BS.
Lets raise our voice together and see if they follow some discipline.
Anyone more than 8-10 years of being in the US and who followed the rules with merit deserves citizenship. Lets voice together as a campaign and get it straight. Yes, I am in the US for 9 years now..

I'm not sure if I'm eligible to apply for Master's quota. I'm done with all my degree requirements and I've scheduled my thesis defence on MAy 20th. Is it still possible that I can apply in Master's quota. I've a letter from my schools which states that I'm done with all my degree requirements and I'll be finishing thesis on May 20th. Is this letter enough to apply for MAsters??

my reply was only meant to highlight what you have been doing on this thread. i do not care who is in which EB category. and i know exactly how people with masters degrees suffer in EB3. however, for you to argue that all category preference should just disappear, is quite ridiculous and i have explained the reasons to you. that does not mean people in EB3 are not suffering or that all those in EB3 are either holding advanced degrees or 3 year bachelor degrees. that stereotyping is in your head alone. certainly not in mine. you never answered any of my questions though. what would be the effect of YOUR solutions? would people like me EVER get a GC?
